Terms of Use & Story Submission Agreement

Welcome to You Can’t Chart This LLC (“Publisher,” “we,” “our,” or “us”).

These Terms of Use & Story Submission Agreement (“Agreement”) govern your access to and use of this website and any story submitted through it. By accessing this website, submitting a story, or checking the required acceptance box, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, please do not use this website or submit a story.

1. Purpose

You Can’t Chart This exists to collect, review, edit, and publish true stories submitted by healthcare professionals.

Submission of a story does not guarantee publication.

If your story is selected for publication, you will be contacted separately and required to execute a Publication Agreement before publication. No ownership rights are transferred by submitting a story through this website.

2. Eligibility

By submitting a story, you represent and warrant that:

  • You are at least eighteen (18) years of age.

  • You are voluntarily submitting your story.

  • You have the legal authority to submit the material.

  • You have read and agree to this Agreement.

3. Story Submission Requirements

By submitting a story, you represent and warrant that:

  • The story is your original work, or you otherwise have the legal right to submit it.

  • The story is truthful to the best of your knowledge.

  • The story does not knowingly violate any law.

  • The story does not knowingly violate another person’s copyright, trademark, privacy rights, or other legal rights.

  • The story does not contain knowingly false or defamatory statements.

4. Protecting Privacy & Confidentiality

Protecting patient confidentiality is one of the core principles of this project.

Before submitting your story, you agree that you have removed or sufficiently altered information that could reasonably identify a patient, family member, healthcare provider, coworker, or healthcare facility.

This includes, but is not limited to:

  • Patient names or initials

  • Dates of birth

  • Medical record numbers

  • Social Security numbers

  • Phone numbers

  • Email addresses

  • Home addresses

  • Photographs or videos

  • Hospital, clinic, EMS agency, or facility names

  • Physician names

  • Coworker names

  • Room numbers or unique identifiers

  • Specific treatment dates when identifying

  • Any other information that could reasonably identify an individual

If necessary, contributors are encouraged to change nonessential details (such as age, timeline, or season) provided the overall truth and substance of the story remain accurate.

If you are unsure whether information could identify someone, do not include it.

The Publisher reserves the right to edit or reject any submission containing identifying information or presenting privacy concerns.

5. Editorial Review

All submissions are subject to editorial review.

The Publisher reserves the right to:

  • Accept or reject any submission.

  • Request revisions or clarification.

  • Edit submissions for grammar, spelling, formatting, readability, style, and privacy protection.

  • Decline publication for any reason.

Submission alone does not create an obligation to publish any story.

6. Ownership Prior to Publication

Submitting a story does not transfer ownership of your work.

You retain ownership of your story unless and until a separate Publication Agreement is executed after your story has been accepted for publication.

7. Publication Agreement

If your story is accepted for publication, you will receive a separate Publication Agreement.

Publication will not occur until that Agreement has been executed by both parties.

The Publication Agreement will govern ownership of the accepted story, copyright assignment, publication rights, editing rights, compensation (if any), and future use of the story.

8. Compensation

Submission of a story does not entitle you to:

  • Publication

  • Payment

  • Royalties

  • Profit sharing

  • Compensation

Any compensation, if offered, will be governed solely by the Publication Agreement.

9. Prohibited Content

You agree not to submit material that:

  • Violates any law, including HIPAA.

  • Contains protected health information or other identifying information.

  • Contains knowingly false statements.

  • Is defamatory.

  • Infringes another person’s intellectual property rights.

  • Contains malicious software or harmful code.

  • Violates another person’s privacy.

10. Disclaimer

Stories published by You Can’t Chart This represent the experiences and opinions of individual contributors.

They are published for storytelling and educational purposes only.

Nothing contained on this website or in future publications constitutes medical, legal, or professional advice.

11. Limitation of Liability & Indemnification

To the fullest extent permitted by applicable law, You Can’t Chart This, its owner, editors, employees, contractors, volunteers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from use of this website or reliance upon its content.

By submitting a story, you agree to defend, indemnify, and hold harmless You Can’t Chart This from any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorney’s fees, arising out of your submission or any breach of this Agreement.

12. Changes to this Agreement

The Publisher reserves the right to modify this Agreement at any time.

Updated versions will be posted on this page with a revised Effective Date.

Continued use of the website following publication of any revisions constitutes acceptance of those revisions.

13. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles.

14. Electronic Acceptance

By checking the required acceptance box and submitting a story through this website, you acknowledge that:

  • You have read this Agreement.

  • You understand this Agreement.

  • You agree to be legally bound by its terms.

Your electronic acceptance shall have the same force and effect as a handwritten signature to the fullest extent permitted by applicable law.
